Keep your trademark protected in Russia
If sales have paused, a distributor has changed or another business is challenging your mark, review the registration and the evidence behind it.
Discuss your trademarkCheck three parts of the file
- Registration: the owner, goods and services, expiry date and recorded changes.
- Use: what was sold or supplied in Russia, by whom and during which periods.
- Disputes: notices, claims, negotiations and any deadline requiring a response.
Understand the non-use risk
Under Article 1486 of the Russian Civil Code, uninterrupted non-use for three years can expose protection to early termination for all or some goods. A challenge is not the same as automatic deletion from the register.
Build a factual record
Prepare a dated timeline and the documents you already hold: invoices, delivery records, product packaging, contracts and relevant marketing material. Identify the goods, territory and parties involved. We assess the relevance of the material to the particular dispute; no single document guarantees the outcome.
When commercial activity has stopped
Tell us when sales stopped, why they stopped, whether stock remained in distribution and whether a licensee or another authorised party continued activity. We can review the evidence and the legal options against the actual circumstances. Do not alter or backdate records.
A practical scope of work
The engagement may cover a register review, an evidence assessment, responses to correspondence, renewal or representation in a dispute. These are separate tasks with an agreed scope. Send the registration number and any notice first so urgent work can be identified.
Renewal is one part of maintenance
Keeping track of expiry dates is essential, but paying renewal fees does not settle every question about the mark. Coordinate renewal instructions with the review of use and any pending challenge.
