A Russian provisional refusal: what to check first

Separate international registration from Russian protection

WIPO examines the formal requirements of the international application. The office of each designated member examines protection under its applicable law. A provisional refusal of the Russian designation does not, by itself, refuse protection in every designated country.

Read the underlying notification

Check the international registration number, holder, Russian designation, total or partial scope, and affected goods and services. A Gazette entry is not a substitute for the underlying reasoning. Consult the relevant notification and subsequent documents in Madrid Monitor.

Identify the deadline and procedure

Check the actual notification for the response deadline, its starting point and the applicable procedure. Distinguish a response to a provisional refusal from a challenge to a later decision: the work required may differ.

Prepare focused instructions

Provide the complete notification, filing or registration details, goods and services you wish to retain, and relevant correspondence. The response strategy depends on the grounds raised and the evidence available.
